§ 10.16.120. Speed limits on county-maintained unpaved roads.

    Findings. According to California Vehicle Code (CVC) Section 22365 "Prima Facie Speed Limit: South Coast Air Quality Management District: Local Ordinances" notwithstanding any other provision of law, any county, which is contained, in whole or in part, within the South Coast Air Quality Management District (SCAQMD), may, if the county determines that it is necessary to achieve or maintain state or federal ambient air quality standards for particulate matter, determine and declare by ordinance a prima facie speed limit that is lower than that which the county is otherwise permitted by the CVC to establish, for any unpaved road under the jurisdiction of the county within the SCAQMD.

    B.

    Applicability. The prima facie speed limit established by this Ordinance shall be effective when appropriate signs giving notice thereof are erected on such unpaved road and it shall be the duty of the director of transportation to erect and maintain such signs.

    C.

    Appropriate speed limits. For the purpose of CVC Section 22365, the designated speed limits shall be either fifteen (15) miles per hour (mph), or twenty (20) miles per hour, or twenty-five (25) miles per hour. The selected speed limit for a segment of unpaved road shall be recommended by the director of transportation based on an engineering study.

    D.

    Fifteen miles per hour. The prima facie speed limit is 15 miles per hour:

    On the dirt segment of Box Springs Mountain Road between a point 1,300 feet west of Running Gun Lane to a point 4,468 feet west of Running Gun Lane, a total distance of approximately 0.6 miles, in the Moreno Valley area.

    E.

    Twenty miles per hour. The prima facie speed limit is 20 miles per hour:

    On De Luz Road from Granado Place to a point 2,785 feet north of Via Medeiros, a total distance of approximately 0.94 miles, in the Temecula area.

    F.

    Twenty-five miles per hour. The prima facie speed limit is 25 miles per hour:

    Repealed.

    2.

    On the dirt segment of Olivas Avenue between a point 320 feet north of Cobblestone Street and Central Avenue, a total distance of 0.16 miles, in the Nuevo area.

    3.

    On Borel Road between Sky Canyon Drive and Leon Road, a total distance of approximately 1.20 miles, in the French Valley area.

    4.

    On Leon Road between Borel Road and Auld Road, a total distance of approximately 0.76 miles, in the French Valley area.
