§ 17.302.080. Permit expiration.

    All conditional use permits granted for a commercial cannabis activity shall be conditioned for the permittee to obtain a valid cannabis license from the State of California within six months of the conditional use permit's approval date. In the event the condition of approval is not complied with, the conditional use permit will automatically become null and void on the six-month anniversary date of the conditional use permit's approval.

    B.

    All conditional use permits issued for a commercial cannabis activity shall expire as provided in each permit's conditions of approval and development agreement. No less than six months from the expiration date, the permittee may request the conditional use permit to be renewed as provided in the development agreement. Any request for renewal shall be in writing to the planning department and in conjunction with a revised permit application. The renewal request and revised permit application shall be processed in accordance with the procedures for processing the original permit, including any requirements for public hearing, notice of hearing and all rights of appeal. If all obligations detailed within the development agreement associated with the permit are not met, the revised permit application and renewal request will be recommended for denial. If a request for renewal is not requested or is not granted the conditional use permit shall be deemed expired on the date set forth in the permit's conditions of approval and development agreement.
