§ 8.55.100. Appeal.

  • Any person who has an application for a food handler certificate denied or revoked by the department, may appeal such denial or revocation by filing a written notice of appeal with the department, within ten (10) days after the date of denial or revocation. A written notice of appeal should briefly set forth the reasons why the denial or revocation is not proper. The department shall give notice of the time and place of the hearing to the appellant.

    Such appeal shall be heard by a hearing officer who may affirm, amend or reverse the decision or take such other action as it deems appropriate. In conducting the hearing, the hearing officer shall not be limited by the technical rules of evidence.
