§ 4.04.010. Procedure for filing.

    Pursuant to Section 935 of the Government Code, all claims against the county for money or damages which are excepted by Section 905 of the Government Code from the provisions of Division 3.6 of the Government Code (Section 810 et seq.), and which are not governed by any other statutes or regulations expressly relating thereto, shall be governed by the procedures prescribed in this section.

    B.

    A signed, written claim shall be presented to the county by mailing or delivering it to the clerk of the board of supervisors or to the county auditor-controller or to the board of supervisors by the claimant or by a person acting on his or her behalf. The claim shall conform to the requirements of Section 910 of the Government Code or of a form provided by the county if such form is provided.

    C.

    Unless otherwise provided in this section, the procedures for presentation, consideration and action upon all claims filed pursuant to this section shall be the same as the procedures provided and required by Section 910 through 915.2 of the Government Code, except Section 911.2, which provisions and sections are adopted as the requirements of this section.

    D.

    A claim under this section shall be presented not later than the time period prescribed by Section 911.2 of the Government Code after the accrual of the cause of action. Upon written request prior to the expiration of the prescribed time in which to present a claim, the board of supervisors may extend the time for filing a claim. The presentation and action on claims provided herein shall be a prerequisite to suit thereon, and such suit shall be subject to the provisions of Sections 945.4 and 945.6 of the Government Code.
